In a significant turn of events, the Court of Appeal in Abuja has overturned the judgment of the Federal Capital Territory High Court, effectively nullifying the restraining order against Julius Abure and two other national officers of the Labour Party (LP).
The ruling, delivered on April 5, 2023, by Presiding Judge Hamza Muazu, had initially restrained Abure, along with Farouk Ibrahim, Clement Ojukwu, and Oluchi Opara, from acting in their capacities as national officers of the LP. This decision came in response to an ex parte application.
Furthermore, the high court had dismissed Abure’s objection to his removal as LP chairman, which stemmed from accusations of forgery and unlawful substitutions in the last elections.
The lawsuit, brought forth by Martins Esikpali John, Lucky Shaibu, Isah Zekeri, Omogbai Frank, Abokhaiu Aliu, Ayohkaire Lateef, John Elomah, and Ayobami Arabambi, alleged that Abure and others had forged documents of the FCT high court.
However, in a landmark ruling, the appeal court declared that the high court had erred in assuming jurisdiction over the matter.
Justice Hamman Barka, delivering the lead judgment, emphasized the wrongful jurisdiction assumption and awarded N1 million in favor of the appellants.This decision marks a significant victory for Abure and the other defendants, who sought redress through the appeal court.
